These Terms of Use (the “Terms”) govern access to and use of the Intsurfing website, available at https://www.intsurfing.com (the “Website”), as well as the services and materials provided therein. These Terms apply to all visitors and users of the Website (collectively, the “User”) and define the rights, obligations, and responsibilities of the User and LLC “INTSURFING” (the “Company”).

By accessing or using the Website, the User acknowledges that they have read, understood, and agree to be bound by these Terms. If the User does not agree with any provision herein, they must immediately discontinue use of the Website.

The Company reserves the right to amend or supplement these Terms at any time. The current version of the Terms is published on the Website along with the date of the latest update. Continued use of the Website following any changes constitutes the User’s acceptance of the revised Terms.

Certain services or features provided by the Company may be subject to additional agreements or policies. In the event of any conflict between such documents and these Terms, the provisions of the specific agreements shall prevail.

The Website is provided for informational purposes only and does not constitute a public offer or commercial proposal. No content on the Website shall be interpreted as an offer to enter into a contract or as a guarantee of any services without the Company’s explicit prior consent.

  1. DEFINITIONS
    1. Website – refers to the Intsurfing company website, available on the Internet at https://www.intsurfing.com, including all of its subdomains, sections, and content. The term “Website” also includes all features and services accessible to the User through its web interface.
    2. Company – refers to LLC “INTSURFING”, a legal entity that owns the Website and provides services through it in the field of big data processing and analysis. In these Terms, the terms “Company,” “We,” or “Us” mean Intsurfing and its authorized representatives.
    3. User – means any natural or legal person with legal capacity who visits the Website and/or uses its features or materials. This includes both unregistered visitors and individuals who submit project-related information to the Company or engage in communication through the Website.
    4. Services – means all offerings, functionalities, and features made available by the Company through or in connection with the Website. This includes, without limitation, big data consulting and solutions, data integration and analysis, cloud solutions, and any other services or information the Company may provide to Users.
    5. Content – means all materials and information made available on the Website, including text, graphics, logos, images, videos, software code, databases, technical descriptions, articles, blogs, and other objects of intellectual property. Content may be owned by the Company or by third parties such as partners or clients, and is protected by intellectual property laws.
    6. Personal Data – means any information relating to an identified or identifiable natural person (the User) that is collected or processed during the use of the Website. Such information includes, but is not limited to, first and last names, company name, email address, phone number, project-related information, and any other data voluntarily provided through forms on the Website, as well as technical data (such as IP addresses, cookies, and similar) that may be collected automatically during Website visits.
    7. Third-Party Resources – means any external websites, services, or applications that are not owned by the Company and which may be accessible through hyperlinks provided on the Website.
  2. ACCESS TO THE WEBSITE AND TERMS OF USE
    1. The Company, incorporated under the laws of Ukraine, grants the User a limited, non-exclusive, revocable, and non-transferable right to access the Website and the materials made available thereon (the “Content”) strictly for personal or internal business use.
    2. The Content available on the Website is protected under the laws of Ukraine and applicable international legal instruments, including the Berne Convention, the Digital Millennium Copyright Act (DMCA), and other relevant intellectual property protection regulations.
    3. The User does not acquire any ownership rights or licenses to the Content, except for the limited right of access expressly granted under these Terms.
    4. Without the Company’s prior written consent, the User is prohibited from copying, reproducing, modifying, adapting, distributing, or otherwise using the Content for commercial or non-commercial purposes; creating derivative works based on the Content; engaging in web scraping, data harvesting, parsing, or any other automated activity aimed at collecting information from the Website; or using the Content to develop competing products or services.
    5. The User is further prohibited from circumventing, removing, deactivating, or otherwise interfering with any technical measures that protect or restrict access to the Website or the Content; and from violating any digital rights management (DRM) tools or other security mechanisms that protect the Content under the DMCA, the Law of Ukraine “On Copyright and Related Rights,” or analogous legislation applicable within the European Union.
    6. The Company reserves the right, at its sole discretion, to suspend or permanently revoke the User’s access to the Website in the event of any violation of these Terms or applicable law.
  3. WEBSITE FUNCTIONALITY AND STRUCTURE
    1. The Website serves as the official informational platform of Intsurfing, providing public access to information about the Company, its services, and its domain-specific expertise. It is intended for familiarization with the Company’s activities, access to informational materials, and initiation of communication with the Company.
    2. The Website is not an e-commerce platform and does not support the creation of personal accounts, user registration, or the execution of electronic agreements directly through its web interface.
    3. The Website is organized into the following primary sections and functional components:
      1. Main Page – provides general information about the Company, its specialization in the field of Big Data, a brief overview of core services, and its competitive advantages.
      2. About – offers a detailed description of the Company’s profile, experience, industry focus, values, and approach to implementing analytical solutions.
      3. Services – contains information about the Company’s consulting, analytical, integration, and cloud services. Each service is presented with a concise description, examples of use cases, and details on key competencies.
      4. Technology Stack – presents both visual and textual representations of the main technologies utilized by the Company in the execution of Big Data projects, including .NET, Python, Scala, Java, AWS, C#, and others.
      5. Projects (if applicable) – showcases successfully delivered projects, along with practical examples of implemented solutions and analytical tools across various industries.
      6. Contact Us – provides the Company’s current contact details, including legal address, email, and phone number, as well as an interactive form for submitting inquiries or initiating communication with the Company.
    4. The Website may additionally feature graphical, audio, and video materials for presentation purposes; elements of the Company’s branding and visual identity; and informational or analytical articles, blogs, or news items.
    5. The Website does not support online ordering, electronic payments, user registration, or account creation. All inquiries are submitted exclusively through feedback forms or direct contact with the Company.
    6. As part of its operation, the Company may utilize third-party analytics services, including Google Analytics and Serpstat, to collect statistical and technical data regarding User interaction with the Website, in accordance with the Privacy Policy.
    7. The Company reserves the right, at its sole discretion, to modify the structure, functionality, design, and content of the Website, including by adding new sections or removing existing ones, without prior notice to Users.
  4. USER REGISTRATION, INFORMATION SUBMISSION, AND WARRANTIES
    1. The Website is intended solely for informational purposes, and no registration is required to access publicly available materials. However, in order to access certain services — including but not limited to submitting feedback requests, requesting consultations, sending project descriptions, or seeking a commercial proposal — the User may be required to provide certain information via designated forms or other interactive elements on the Website.
    2. To submit a feedback request, the User must:
      1. complete the relevant form by entering all required data as indicated in the form fields (such as name, email address, company name, subject of the inquiry, a brief project description or question);
      2. confirm that they have read and accepted these Terms and the Privacy Policy by checking the corresponding box in the form interface;
      3. optionally provide additional information in the free-text field of the form.
    3. After completing the form, the User submits the information to the Company by activating the “Send” button or a similar command in the web interface. Once submitted, the information is processed in accordance with the Privacy Policy.
    4. The User agrees to provide only accurate, current, complete, and truthful information. At its sole discretion, the Company reserves the right to refuse the provision of services if the information submitted is found to be false, inaccurate, or incomplete.
    5. The User represents and warrants that:
      1. they are acting on their own behalf or on behalf of an organization they are duly authorized to represent;
      2. they possess the necessary legal capacity and authority to enter into agreements or submit information as provided through the Website’s functionality;
      3. they are not misleading the Company with respect to their status, authority, or intentions.
    6. The User is prohibited from engaging in the following activities:
      1. violating applicable laws or the rights of third parties when using the Website;
      2. interfering with the Website’s operation, bypassing technical safeguards, or attempting unauthorized access;
      3. transmitting viruses or malicious software through the Website, or creating an excessive load on the Website’s infrastructure;
      4. using the Website for commercial purposes without the Company’s prior consent, including extracting Content, posting advertisements, or sending spam;
      5. impersonating another person or entity or providing false information when interacting with the Website;
      6. using the Company’s trademarks, logos, or other intellectual property without proper authorization.

The Company is not obligated to review such content in advance and does not guarantee its legality or accuracy. At its sole discretion, the Company reserves the right to delete or block any information received from the User.

    1. The User agrees to use the Website and the information published on it strictly by the laws of Ukraine, applicable international standards, and solely to learn about the Company’s activities or obtain services expressly offered through the Website.
    2. The User further agrees to refrain from any actions that may:
      1. infringe upon the intellectual property rights of the Company or third parties;
      2. damage, disrupt, or suspend the functionality of the Website, including through hacking attempts, unauthorized access, or interference with the Website’s code or infrastructure;
      3. interfere with other users or abuse the Company’s technical resources, such as by distributing spam, launching DDoS attacks, or introducing malicious software.
    3. The User shall not upload, publish, or disseminate via the Website any of the following:
      1. information that infringes the rights of third parties;
      2. confidential information without legal authorization;
      3. unlawful, defamatory, offensive, discriminatory, or otherwise harmful content;
      4. content containing viruses, malware, or other malicious code.
    4. Indemnification – The User agrees to indemnify and hold harmless the Company, its representatives, affiliates, and partners from and against any losses, penalties, or expenses (including reasonable legal fees) incurred as a result of: a breach of these Terms; infringement of the rights or legitimate interests of third parties; or any unlawful acts or omissions committed by the User in connection with the use of the Website.
  6. COMPANY RIGHTS
    1. The Company reserves the right, at any time and at its sole discretion, without prior consent or notice to the User, to:
      1. remove, restrict access to, edit, or block any Content published on the Website if the User violates these Terms or applicable law;
      2. suspend, limit, or permanently terminate the User’s access to the Website if their actions pose a risk to the Company’s reputation or the Website’s operation;
      3. modify the structure, design, navigation, functionality, or technical components of the Website;

    2. The Company does not guarantee uninterrupted availability of the Website or the absence of technical failures, outages, or other defects that may temporarily affect its performance.

    1. If the User submits any materials or information to the Company through the Website, including but not limited to project descriptions, technical specifications, messages, or other data, the User grants the Company a non-exclusive, royalty-free, and worldwide right to process, use, store, and analyze such materials strictly for the purpose for which they were submitted.
    2. The Company does not acquire ownership of such materials but reserves the right to use them for preparing commercial proposals, providing consulting services, or conducting preliminary assessments of the User’s inquiries.
    3. The Company guarantees the confidentiality of information provided by the User, in accordance with the Privacy Policy.
    4. The User represents and warrants that the materials they submit do not infringe upon third-party rights and may be lawfully processed by the Company.
  8. ADVERTISING AND PROMOTIONAL MATERIALS
    1. The Company reserves the right to display advertising and informational materials on the Website, including banners, embedded advertising blocks, native advertisements, partner content, or other commercial communications.
    2. Such materials may originate from the Company or third parties. The Company shall not be liable for the content of advertisements placed by third parties.
    3. The User acknowledges and agrees that viewing promotional materials is an inherent part of using the Website.

    3. The Company communicates exclusively in electronic form unless otherwise required by law.

  11. DISCLAIMER OF PUBLIC OFFER
    1. The information on the Website does not constitute a public offer under Article 641 of the Civil Code of Ukraine unless expressly stated otherwise.
    2. No content or functionality creates contractual relations absent a separate written agreement.
    3. Inquiries submitted are preliminary and do not obligate the Company to enter into any contract.

  13. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES

    2. The Company makes no warranties regarding uninterrupted operation, accuracy, or suitability for specific purposes.
    3. The Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of the Website.
    4. To the maximum extent permitted by law, the Company’s liability is limited to zero monetary compensation.
    5. The Company may suspend or restrict access for maintenance without liability for resulting losses.
  14. GOVERNING LAW, DISPUTE RESOLUTION, AND FORCE MAJEURE
    1. These Terms are governed by the laws of Ukraine, without regard to conflict-of-law provisions.
    2. Disputes must first be preceded by a written claim via email; the Company has 30 days to respond.
    3. If unresolved, disputes are submitted to the courts of Ukraine, though the Company may pursue proceedings elsewhere if its rights are infringed internationally.
    4. The Company is not liable for failures or delays caused by force majeure events beyond its reasonable control.
  15. PERSONAL DATA PROTECTION
    1. The Company processes Personal Data in accordance with Ukrainian law, the GDPR (for EU Users), and the CCPA (for US Users).
    2. Personal Data is used solely to fulfill these Terms, respond to inquiries, and pursue legitimate interests.
    3. Detailed data-protection provisions are set out in the Privacy Policy, which is an integral part of these Terms.
    4. By submitting Personal Data, the User consents to such processing under these Terms and applicable law.
  16. CHANGES TO THE TERMS
    1. The Company may modify these Terms at any time, at its sole discretion, without prior notice.
    2. Changes take effect upon publication on the Website, unless stated otherwise.
    3. Continued use after changes constitutes acceptance of the updated Terms.
  17. FINAL PROVISIONS
    1. These Terms constitute the full agreement between the Company and the User regarding the Website.
    2. If any provision is held invalid, the remaining provisions remain in effect.
    3. The Company’s failure to enforce any right under these Terms does not constitute a waiver of that right.
    4. Section headings are for convenience and do not affect interpretation.
    5. In case of discrepancy between language versions, the Ukrainian version prevails.
    6. Cookie and Analytics Policy – The Company may use cookies, web beacons, and similar technologies (e.g., Google Analytics, Serpstat) to collect technical and analytical data. Detailed information is in the Privacy Policy.
